Legally Humorous…

Sometimes, you need a little humor to see the light at the end of the tunnel…these are offered to help lighten the seriousness of what you are facing when you are charged with a criminal offense…

…but there are some things that are better left unsaid, like trying to tell a joke when the Judge asks you why you were late for Court…

Sometimes, we really do make a mistake in what we think is happening…

…and when the cops mistakenly think that your actions are deliberate, you can end up with far more than a traffic ticket, as in a criminal charge of eluding…and don’t expect your explanation of what you thought to be accepted unless it is VERY reasonable.

When you decide to go to trial, you place your freedom and your future in the hands of 12 people you never met, who will decide your innocence…

in the hands of

…or guilt, and you have to hope they follow the instructions the Judge gives them on the law…

Picking a jury is not simple, with many factors influencing who you and the State want to have decide the ‘guilt or innocence of a defendant. Chose wisely, there are no ‘do-overs’.

So…what did you really think those cops were after…

ignore it

When you are signaled to stop, your failure to stop can expose you to a 2nd degree prison sentence (5-10 years) even if you were being pulled over for a traffic offense.

Unfortunately, the fact that were the one stopped or arrested and everyone else wasn’t, is not much use as a defense…

everyone else

‘I was just doing what every one else was’ is not a legal defense to anything, not even a speeding ticket. TANSTAAFL. ‘You broke it, you pay for it’.

No Statement

The police know how to look on social media, and you posting a picture, smiling, at the location, with the weapon and the proceeds of the criminal act is evidence against you.

Hobson’s Choice. If you slow down too abruptly, that can be the basis for the cops (if it is them) to pull you over. If you don’t slow down and it is the cops, its ‘Ticket Time’

When you are being charged with a crime is when you have to realize that it is better to remain silent and be thought a fool, than to open your mouth and remove all doubt.

When you find yourself in a hole, STOP DIGGING! When you find out that you are being charged with a crime, STOP TALKING! You can’t fix this from the bottom of the hole, but you can make it a lot worse!

What you do, and sometimes what you don’t do when you should, give the cops a reason to stop you…from that point on what happens is ‘Plain View’… Best legal advice??…STOP DRIVING UNDER THE INFLUENCE!

Sometimes, there is no adequate explanation to ‘how did this happen’ that avoids you being charged with a crime, and you are better off saying nothing…as in ‘Silence is a virtue’ and ‘You have the right to remain silent’…

on the other hand

You have to keep as many options open as you can, because there is no certainty you will be successful at negotiating a dismissal or a low sentence, or in getting a better result on appeal than you did at trial.
